KHUSHBOO SUES MAXIM INDIA
(February 18, 2006)

KhushbooChennai, (India): The famous south Indian actress on whose name a temple was built in Tamil Nadu state of India filed a damage suit against the local edition of British men's magazine Maxim after it published a faked picture of her in a skimpy swimsuit for Rs30mn ($677,000). In its debut December issue, the magazine superimposed the head of the 35-year-old star atop the body of another woman clad in scanty black underwear.

Maxim IndiaKushboo said that she received a phone call from the publishers head office to settle the issue out of the court but she refused to do as the damage is already done to her image and reputation which is irreversible. She said that the "story and the photograph are both in bad taste" and she was "very upset." Maxim was given three weeks to "pay up" or it would face a defamation suit, Khushboo said.

Khushboo hinted the magazine might face a second legal suit from her husband Sundar C, a well-known film personality. He has filed a criminal case against Maxim for not following an Indian law that makes it mandatory for every publication to have its editorial address in every copy.

Maxim’s India edition only carried a marketing office address. "This delayed our communication to them as we had no addresses to write to and had to search for the editorial office," Khushboo said.

A mother of two, Khushboo got into controversy when she said that it is nothing wrong with premarital sex as long as the girl is protected herself against sexually transmitted diseases and pregnancy. Although she apologized for the comments made conservative social and political groups have physically attacked her.

"We have already apologized and we are quite taken aback by this (legal notice)," Mehra said. "We are willing to talk and assuage her hurt feelings. It (the picture) was a spoof and even carried the headline '100 percent fake'."
